Two Amelia residents are charged after allegedly threatening and attacking a driver and two passengers.

Witherspoon, 21, and Brittany Acres, 20, went in front of the Grand Jury on Sept. 1 and were charged with one count of felonious assault, a second degree felony, and two counts of aggravated menacing, a first degree misdemeanor.

Joey Witherspoon
Witherspoon was allegedly hit by a driver while he was crossing Lucy Run Road on foot near Amelia Olive Branch Road on Aug. 15. He then approached the driver and hit the van with a softball bat, said Carol Rowe, assistant prosecuting attorney.

The driver got out of the car to try and defuse the situation, and Witherspoon allegedly hit him with the bat and gave the driver a minor injury. Acres had a kitchen knife and threatened two passengers and the driver with it.

Neither Witherspoon nor the driver needed medical care, Rowe said.

Both Witherspoon and Acres had their bond hearings, both received a $25,000 bond and both have since signed themselves out. They will go to pretrial on Sept. 20 with Judge Victor Haddad.
