Charges have been filed against the driver of a car involved in a crash that killed an Amelia High School student in March.

Larry Molloy, 41, was indicted on aggravated vehicular homicide, endangering children and tampering with evidence charges June 20, according to Hamilton County Court records.

Molloy was driving the car that crashed on Interstate 275 near Kellogg Avenue March 9.

According to Cincinnati Police, Damien Henderson, 16, who was a sophomore at Amelia High School was ejected from the rear window of a vehicle when it went out of control on the interstate.

Police said Larry Molloy, 41, was driving a Mercedes ML350 east on Interstate 275 when he lost control of the car.

The car driven by Molloy struck the guardrail on the left side of the road and the car continued to rotate to the right lane.

Henderson was transported to Mercy Hospital Anderson were he died from his injuries.

Other passengers in the car were not injured in the crash. Daniel Hesslin, 17, was in the front passenger seat and Dylan Molloy, 14, was in the back seat.

Larry Molloy, Dylan Molloy and Daniel Hesslin were all wearing seat belts at the time of the crash.

Damien Henderson was not wearing a seat belt.

Police said at the time that speed, alcohol, and failure to wear a seat belt appeared to be factors in the crash.

According to Hamilton and Clermont county court records, Molloy had been charged with driving under the influence and for speeding before, including an OVI charge and endangering children charges in Hamilton County in 2007 and an OVI charge in Clermont County in 2009.

Molloy was booked at Hamilton County Jail June 23, according to court records. He is scheduled for a hearing 8:45 a.m. July 7 in front of Judge Beth Myers.

In addition to the charges from the state, the family of Henderson filed a lawsuit against Molloy in March.

Kim Johnson, as administrator of Henderson’s estate, filed a wrongful death and injury demand in Hamilton County March 21, according to Hamilton County court records.
