VILLAGE OF BATAVIA
Resolution 217-14 AMENDED
A resolution consenting to an Agreement with the Ohio Department of Transportation regarding the maintenance of S.R. 32 from W. Main Street to the Ramps for S.R. 222.
Whereas, the Village Council of Batavia, Ohio, has annexed portions of S.R. 32, and
Whereas, the Ohio Department of Transportation has requested cooperation with the State of Ohio in the maintenance and any improvements to S.R. 32 between W. Main Street and the Ramps to S.R. 222,
Be it resolved by the Village of Batavia, Ohio:
Section 1:
That the Village of Batavia consents to the Agreement identified by ODOT as PID No. 87304 D08-M&F-FY2015, as follows:
Section 1 – Project Description
WHEREAS, the LPA (Local Public Agency = Village of Batavia) and the State of Ohio have identified the need for the described project;
Perform pavement repairs ( longitudinal joint repairs) on portions of SR 32 in the Village of Batavia from the ramps to W. Main Street (SLM 6.46) to the ramps to SR 222 (SLM 7.70)
NOW, THEREFORE, be it ordained by the Village of Batavia, Ohio;
Section II – Consent Statement
Being in the public interest, the LPA gives consent to the Director of Transportation to complete the above described project;
Section III – Cooperation Statement
The LPA shall cooperate with the Director of Transportation in the above described project as follow:
The State shall assume and bear 100% of all the costs of the improvement,
The LPA agrees to pay 100% of the cost of those features requested by the LPA which are determined by the State and Federal Highway Administration to be unnecessary for the Project;
Section IV – Utilities and Right-of-Way Statement
No additional Right-of-Way or Utility relocation is required for this project;
Section V – Maintenance
Upon completion of this Project, and unless otherwise agreed, the State shall: (1) provide adequate maintenance for the Project in accordance with all applicable State and Federal law, including, but not limited to, Title 23, U.S.C., Section 116; (2) provide financial provisions, as necessary, for the maintenance of the Project; (3) maintain the right-of-way, keeping it free of obstructions; and (4) hold said right-of-way inviolate for public purposes;
Section VI – Authority to Sign
The Mayor and/or Administrator of said Village of Batavia is hereby empowered on behalf of the Village of Batavia to enter into contracts with the Director of Transportation necessary to complete the above described project.
Section 2:
That the Village Council declares this resolution to be an emergency measure that affects the health and safety of residents and staff of the village and shall take effect immediately.

In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, held at the CLERMONT COUNTY SHERIFF’S OFFICE TRAINING ROOM, 4470 STATE ROUTE 222, Batavia, Ohio, in the above named County, on TUESDAY, the 11th day of March, 2014, at 10:00 o’clock A.M., the following described real estate, situate in the County of Clermont and State of Ohio, and in the township of TATE

Being situated in Military Survey No. 2949, in the Township of Tate, in the County of Clermont, in the State of Ohio, and bounded and described as follows:
Beginning at a spike in the South line of the original 35 acres of which this was a part in the roadway of Starling Road and in the line of Charles Hendrixson, said spike being South 72 deg. 30’ West a distance of 952.40 feet from the intersection of the centerline of Starling Road with the Clermont County and Brown County line; thence with the said South line and the line of Hendrixson, South 72 deg. 30’ West a distance of 343.95 feet to a spike at the Southwest corner of the original tract and a corner to Charles Burton; thence with said Burton’s line and the West line of the original tract, North 2 deg. 05’ East a distance of 667.35 feet to an iron pin; thence with two division lines through the original tract, South 87 deg. 55’ East a distance of 340.75 feet to an iron pin; thence South 3 deg. 49’ West a distance of 552.30 feet to the beginning, containing 4.642 acres more or less, and subject to all legal highways and easements.
A survey of the above property was made by Robert E. Satterfield, Surveyor No. 4238, West Union, Ohio, in June, 1966.
SAVE AND EXCEPT that certain tract of 1.3561 acres as conveyed at Official Records Volume 1383, Page 121, Clermont County, Ohio, and described as follows:
Situated in the State of Ohio, Clermont County, Tate Township, in Lytle’s Military Survey No. 2949 and being more particularly described as follows:
Beginning at a spike found in Starling Road, North of the centerline and being South 72 deg. 30’ West, 952.4 feet, more or less, from the intersection of the centerline of said Starling Road with the Clermont County-Brown County line, and also being the Southeast corner of a 4.642 acre tract conveyed to Burton L. Smith Sr. and Patricia Ann Smith by deed recorded in Deed Book 491, Page 49;
Thence, with the Southerly line of said Smith, South 72 deg. 30’ 00” West, 150.00 feet to a mag nail set in Starling Road;
Thence, leaving said road and being severance lines for the next two courses and distances, North 3 deg. 49’ 00” East, passing a 5/8 inch iron pin set at 18.00 feet, a total distance of 450.00 feet to a 5/8 inch iron pin set;
Thence, South 86 deg. 11’ 00” East, 139.74 feet to a 5/8 inch iron pin set in the Easterly line of said Smith’s 4.642 acre tract;
Thence, with Smith’s Easterly line, South 3 deg. 49’ 00” West passing a 5/8 inch iron pin set at 377.47 feet a total of 395.47 feet to the point of beginning. Containing 1.3561 acres, more or less. Subject to all legal highways, easements and restrictions of record.
The bearings in the above tract are based on Deed Book 491, Page 49. Being part of the land conveyed to Burton L. Smith, Sr. and Patricia Ann Smith by deed recorded in Deed Book 491, Page 49 of Clermont County Recorder’s Office and identified as Parcel No. 32-30-18G-041 on the Tax Maps of said County.
