Blair E. Boggs, Beneficiary of the Campbell Family Revocable Trust Agreement, whose last place of residence is unknown and whose present place of residence is unknown, and Jacob M. Boggs, Beneficiary of the Campbell Family Revocable Trust Agreement, whose last place of residence is unknown, and whose present place of residence is unknown, will take notice that on October 19, 2012, Jacklyn K. Siders, Trustee of the Campbell Family Trust, filed her Complaint for Modification of Trust and Declaratory Judgement and Praecipe for Service in Case No. 2012CVH2123 in the Court of Common Pleas Clermont County, Ohio asking the Court to modify the Trust so as to make it a wholly discretionary trust under O.R.C. § 5805.03 and § 5111.151(G) and for any other just and equitable relief. The Trust became irrevocable when the last of the Grantors passed away and after payment of expenses, the trust was distributed into a separate trust for the sole benefit of Grantor’s daughter, Kimberley A. Campbell. Plaintiff further requests this Court enter a declaratory judgement to the effect that the Trustee is not now and has never been permitted to distribute funds from Kimberly A. Campbell’s Trust to any beneficiary or creditor including the State of Ohio, except for distributions to or for the benefit of Kimberly A. Campbell during her lifetime and that such distributions to or for the benefit of Kimberly A. To: Washtenaw Mortgage Company, whose last known place of business c/o National Registered Agents, Inc., 145 Baker Street, Marion, OH 43302 you will take notice that on the 18th day of November, 2011, Plaintiff, filed a Complaint for foreclosure in the Clermont County Court of Common Pleas, being Case No. 2011 CVE 02084, alleging that there is due to the Plaintiff the sum of $151,372.08, plus interest at 4.75% per annum from April 1, 2011, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of 2396 Woodville Pike, Goshen, OH 45122, being permanent parcel number PPN: 112211C156.
Plaintiff further alleges that by reason of a default in payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendant named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
Said Defendant is required to file an Answer on or before the 17th day of January, 2013.
