Being the same premises conveyed to Robert R. Kimmerly, Jr. by quit claim deed found of record in Volume 1887, page 100 of the Clermont County Official Records; see also, deed to Robert R. The Complaint alleges that the said Robert Wayne Kimmerly is next of kin of the decedent; that it is necessary to sell the subject real property in order to pay the debts and expenses of administering the decedent’s estate; that it is in the best interest of the estate to sell the subject real estate.
The Complaint further alleges that the subject real estate was appraised for purposes of the Amended Inventory and Appraisal filed in the estate proceedings on May 1, 2009, and approved on May 5, 2010, for the sum of $40.000.00; that plaintiff requests the court order a further appraisal pursuant to section 2127.22 ORC and the value returned shall be the appraised value thereof for purposes of these proceeding.
The Complaint further alleges that all defendants be required to set forth any claim, lien or interest in or upon the above described premises which he or she may have or be forever barred therefrom; that all liens upon said premises be marshalled; that said premises sold in accordance with law.
Robert Wayne Kimmerly and the unknown heirs, devisees, executors and administrators of Robert Wayne Kimmerly are further notified that they are required to answer said Complaint within 28 days after September 13, 2012, the date of the last publication of this Notice, and to serve a copy of his or their answer of plaintiff’s attorney who is Lawrence Walker, attorney at law, 60 N. Plaintiff has brought this action naming you as a Defendants by filing a Complaint on August 1, 2012 in the Clermont County Court of Common Pleas for the foreclosure of liens for delinquent taxes, assessments, penalties, interest and charges against certain real property described in the Complaint.
The object of the action is to obtain from the Court a judgement foreclosing the tax liens against such real estate and ordering the sale of such real estate for the satisfaction of the tax liens thereon.
