RESOLUTION ESTABLISHING REVISED LICENSE FEES FOR VENDING MACHINE LOCATIONS PURSUANT TO OHIO REVISED CODE SECTION 3709.09 AND 3709.21.
WHEREAS, the Board of Health of the Clermont County General Health District has the authority pursuant to Ohio Revised Code Sections 3709.09 and 3709.21 to establish a uniform system of fee services; and
WHEREAS, the Board of Health of the Clermont County Health District is mandated to provide services that protect the public health and prevent or restrict disease, and abate or suppress nuisances; and
WHEREAS, the Board of Health of the Clermont County Health District has determined that it is necessary to revise the license fees for vending machine locations; and
WHEREAS those parties that would be affected by the proposed vending fees were notified at least 20 days prior to the January 11, 2012 Board of Health meeting that a public hearing on the proposed revised vending fees would be held at 6:30 pm on January 11, 2012 at the regularly scheduled Board meeting; and
WHEREAS, the Board of Health of the Clermont County Health District held the hearing on the proposed fees on January 11, 2012 which was prior to passage of this resolution establishing the revised fees.
NOW, THEREFORE, BE IT RESOLVED, by the Board of the Clermont County General Health District, that license fees for the following services be revised as stated:
Health District Fee of $30.47 + State Fee of $6 = Total Fee of $36.47
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the fee revised pursuant to this Resolution hereby become effective on February 1, 2012.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that this Board of the Clermont County General Health District hereby find by a vote of at least three fourths (3/4) of its members that this resolution be read only once, and the requirement that it be read on three different days be dispensed with as provided by law.

WHEREAS, the Board of Health of the Clermont County General Health District has the authority pursuant to Ohio Revised Code Sections 3709.09 and 3709.21 to establish a uniform system of fee services; and
WHEREAS, the Board of Health of the Clermont County Health District is mandated to provide services that protect the public health and prevent or restrict disease, and abate or suppress nuisances; and
WHEREAS, the Board of Health of the Clermont County Health District had previously determined that it is necessary to revise the license fees for vending machine locations; and
WHEREAS, the Board of Health of the Clermont County Health District determined that those parties that would be affected by the proposed vending fees were to properly notified at least twenty (20) days prior to the October 12, 2011 Board meeting at which the public hearing concerning the fee increase held by this Board.

RESOLUTION TO REVISE LOCAL ONSITE SEWAGE TREATMENT SYSTEM REGULATION 415.
WHEREAS, the Board of Health of the Clermont County General Health District has the authority pursuant to Ohio Revised Code Sections 3709.01 to adopt such regulations as are necessary for the public health, the prevention or restriction of disease, and the prevention, abatement or suppression of nuisances; and
WHEREAS, the Board of Health of the Clermont County Health District has the authority to regulate household sewage treatment systems pursuant to Ohio Administrative Code 3701-29; and
WHEREAS, the Board of Health of the Clermont County Health District has previously adopted more stringent standards as local conditions indicated such standards were necessary pursuant to Ohio Administrative Code 3701-29-20 (D); and
WHEREAS, the Board of Health of the Clermont County Health District has determined that these previously adopted regulations require modification and clarification in order to better define the actions necessary to restrict disease and for the prevention, abatement or suppression of nuisances.
NOW, THEREFORE, BE IT RESOLVED, by the Board of the Clermont County General Health District, that the attached Regulation 415 entitled Sewage Treatment System Rules be revised, effective February 1, 2012.

This project is funded with a grant from the Ohio Environmental Protection Agency through the U.S. EPA Clean Water Act, Section 319 program.
