Representing convicted foster mother Liz Carroll, Cincinnati criminal defense attorney Elizabeth Agar argued before the Ohio 12th District Court of Appeals attempting to get her client a new trial Oct. 16.

Liz Carroll was convicted of murdering her 3-year old foster son Marcus Fiesel earlier in the year; she is serving 54 years to life in prison for the crime.

In addition to getting Liz Carroll a new trial, Agar is also arguing to have the lesser three charges of child endangerment and felonious assault merged into the murder charge; a move that would reduce Carroll’s original prison sentence by more than 20 years.

In her oral argument before the three appellate judges, Agar claimed that the prospective jurors that were summoned to serve were biased and had become tainted in their impartiality due to the heavy media exposure that surrounded the case at that time.
